Learning Session Description

When the time comes to handle a touchy employee issue…who do they call??? HR. But is HR properly trained?

Let’s face it: most HR professionals (as well as company executives and managers) never had formal training on how to conduct administrative investigation and gather the necessary evidence against erring employees. Without the proper skills, employees may feel that the company’s investigation was done haphazardly, or worse arbitrarily, thereby prompting them to seek the assistance and intervention of the Department of Labor and Employment (DOLE) or the National Labor Relations Commission (DOLE) by way of a labor complaint.

Labor complaints expose employers to great and costly risks. Dismissed employees may get reinstated to their former positions. Employees illegally terminated would be entitled to backwages, damages, attorney’s fees, interest and other monetary awards that can reach millions of pesos. And of course, companies would be sidetracked from their usual businesses and activities, making them unproductive and uncompetitive.

Learning Session Objectives

The specific objectives of this unique fun-filled learning experience are;

• Learn the basics of how to prepare sworn statements and affidavits, identify witnesses, gather evidence, conduct witness interviews, and document investigative findings;

• Understand what is “substantial evidence” as well as the rules of evidence in labor cases;

• Learn the legal requirements in conducting administrative hearings and conferences;

• Analyze physical, documentary, and testimonial evidence and identify company policies and/or laws that may have been violated;

• Learn a standard format for preparing notices and observing procedural due process;

• Understand what is “preventive suspension” and other temporary protective measures; and

• Learn best practices in handling disciplinary actions and terminations, thereby avoid stepping on legal land mines.
